Second Degree Murder – Statutory Elements

You can find the statute governing second degree murder under Title 21 §701.8.  The offender must act in a way that is (1) imminently dangerous to another, (2) with a depraved mind, and (3) without premeditation for a death to occur.  It can also occur if someone dies while a felony is happening.  Thus, while you may not intend a person to die, if you are committing a felony crime or acting in a way you know to be dangerous and someone dies, you face second degree charges.

Penalties for Second Degree Conviction

Oklahoma laws punish second degree murder offenders more strongly than many other states.  First, you will face a minimum of 10 years in jail.  This,second degree murder however, will be contingent upon if you have any other criminal records and the amount of violence in your actions.  Second, if your actions are severe enough you may face life in jail.  Sometimes this will have the possibility of parole after a certain amount of time.  Finally, you can face charges in civil court as well.  This may mean that you are responsible for thousands of dollars to the surviving family members of the victim.
