Oklahoma Statute Title 22, Chapter 1, § 18(B) defines expungement as: “…the sealing of criminal records, as well as any public civil record, involving actions brought by and against the State of Oklahoma arising from the same arrest, transaction, and occurrence.” Under Oklahoma law, you must fall under one of several different categories in order to qualify for an expungement.  These may include:

–  you received an acquittal or your charge and conviction was reversed;

–  you received exoneration through DNA;

– the Governor gives you a full pardon based on written documentation of actual innocence or you were under 18 yrs. of age during the commission of the crime and receive a full pardon;

– no charges were filed against you during the arrest of the crime in question;

–  all charges of the crime were dismissed (not deferred) and you have no felony charges;

– you have a misdemeanor charge and 1 year has passed without any charges or you have paid fines no more than $500 and have no felonies;

– you have a nonviolent felony charge and 5 years have passed without any new charges or have received a full pardon, have had a no misdemeanors in the last 15 years, and it has been 10 years since the offense;

– If your identity was used by another person to commit crimes in your name.
