Defending Shoplifting and Petty Larceny in Rogers County

Shoplifting and Petty Larceny

Shoplifting and Petty Larceny are crimes that are very common. Recently a Oklahoma City store manager was pepper sprayed when he followed a shoplifting suspect into the parking lot.  The suspect took a pair of fake eyelashes from the Mid K Beauty Supply Store.  When the manager saw it happen, he followed the suspect taking pictures with his cell phone.  The woman is now wanted for battery on the store manager.  While not all shoplifting and petty larceny happens this way, it is still a very common offense.  This article will explain it in further detail.

Oklahoma Statutes on Shoplifting and Petty Larceny

Oklahoma labels shoplifting as “petty theft” or “petit larceny.”  This is under Title 21 §1704.  For authorities to prove you are guilty of petty theft, they must show:

– you took an item from a person or retailer;

– with no intention of paying for it; and

– without any plan to return it.

Additionally, the total amount of the items must be less than $1,000.  If it is not less than the $1,000 amount, then you will be facing more severe charges of grand larceny and the penalties are no longer misdemeanor charges but felonies.

Consequences of shoplifting in petty larceny in Oklahoma include fines and jail time.  For example, depending on the amount and value of the items in question fines may range anywhere from $10 to $500.  Similarly, jail time can extend up to six months if the larceny is severe enough to warrant it.  This misdemeanor charge will also be on your record.  Many employment agencies will require you to list it and some retailers will disqualify you from employment if you have a history of theft.
